Let's Talk About Hannah Dugan, and a Judiciary That's Out of Control

There's been a big uproar over Wisconsin state judge Hannah Dugan over her being arrested by the federal government for her complicity in aiding and abetting the escape or an illegal alien, one with a criminal record.  

First, unlike some claims ICE didn't' barge into her courtroom.  They waited in the hall for the case before Dugan and this criminal to be over before arresting him.  When she found out she huffed and puffed he way out into the hall and chastising them demanding what right they had to arrest this man without an arrest warrant, and to gain time to aid his escape:

......she instructed the agents to obtain a judicial warrant for Ruiz's arrest, which bought time, ultimately leading to the great escape. Federal agents later caught Ruiz, and Judge Dugan was arrested later.

An administrative warrant isn't the same as an arrest warrant.  But, when observing someone committing a crime the police are arresting people daily without a warrant, and if someone is here illegally, by their very presence they're committing a crime, in point of fact, a felony, and since she helped him to escape, that's a crime, and it's punishable by law:

Per 8 U.S.C. § 1324:........(1)(A) Any person who—.........(iii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation;.........shall be punished as provided in subparagraph (B).

According to subparagraph (B), the consequences are steep: Since Dugan presumably acted not for financial gain, which could mean up to 10 years in prison, but for other reasons (e.g., fighting imaginary “Nazis”), she faces fines or up to five years in prison, or both.

April 28, 2025 by Silvio Canto, Jr. writes instead of enforcing the nation's laws judges are acting like immigration activists.  Through their decisions and actions they are in effect writing de facto new immigration "laws".  Unwritten laws based on their personal morality.  Laws no legislature in the nation ever passed.  And in Wisconsin Hannah Dugan isn't an anomaly, she's part of a philosophical cabal, as another Milwaukee County judge joins rebellion.  After all, these laws were written by some old white guys in some dusty old document from the 18th century, and they're far more noble and far wiser being guided by a higher cause.  So, in the universal leftist mind set, that justifies viewing laws actually passed by Congress as meaningless, and can be ignored, and even usurped.   Isn't that a form of insurrection?  Just a thought.
 
Only the Trump administration disagrees.  AG Bondi intends to prosecute these judges who are in violation federal law in their attempt to obstruct the efforts of the Trump administration.  And she needs to look at the governors of these states also.

What's been the reaction from the left? While touting the phrase, “no one is above the law", which no Democrat really believes when it comes to .... well.... Democrats, and those criminals they wish to protect.  Dem Rep. Moore says a judge’s control is ‘bigger, and that “jurists ought to be able to have control of their courtroom, and localities should not be pressured into executing and assisting ICE, and I think that’s the bigger question.”   What a load of clabber, and when asked if Judge Dugan should be required to follow the law she evades answering with more clabber:

“Well, you know what, this is not fair to ask me that question, because she has not had her day in court yet to litigate and to defend herself vigorously, which I think she will do. What you’re asking me to do is…to sort of not go along with what I believe is — because I think that ICE ought to operate and they ought to do it clearly, outside of her — not outside her courtroom, but maybe on the street, where they arrested him on the street was the appropriate place. They should not even have been in the courthouse as far as I’m concerned. And so, to say that they can arrest you in the cafeteria of the hospital, but not in your hospital room, this is slicing and dicing it in such a way where the Justice Department is determined to intimidate the judiciary. And I think that we need to fight back.”

It's interesting, that's not the way they viewed the staged arrests by the FBI of Trump supporters in recent years with swat team early morning arrests of totally non-violent old men forcing a hand cuffed perp walk with the Pravda media there waiting to film it.    
 
Milwaukee’s mayor, Cavalier Johnson, says it's just wrong for Trump to enforce the law and to  scare innocent illegal aliens, implying what Dugan did was the right thing to do.   Did he actually say "innocent illegal aliens"?  If they're here illegally, they're not innocent, they're criminals.  

It appears the entire body of government in Wisconsin is infected with this insanity, as Wisconsin Rep.: Dugan says, what Hannah Dugan did is "what all of us will be called to do in the days and weeks and months to come, and it’s standing up for people in our community that are being targeted by the Trump regime”, and Wisconsin's lawless governor issues guidelines to shield illegal aliens from ICE agents

Democrats chose a hill to die on—they will defend the last violent, human-trafficking Central American gangbanger escape from ICE no matter what the cost. According to documents leaked by conservative radio host Dan O'Donnell, a Department of Administration (DOA) memo dated April 18 lays out explicit steps for Wisconsin state workers to follow when ICE agents arrive at government buildings. Instead of cooperating with federal immigration enforcement, employees are being told to stonewall — refuse to answer questions, deny access to files, and even demand agents leave if no attorney is available.

What about Democrat governors around the nation?  Arizona Gov. Hobbs has vetoed a  bill that requires the police to cooperate with ICE, which matters little because there's federal law that requires state law enforcement to cooperate, and at some point I'm convinced the Trump administration will start invoking and enforcing that law, which means legislators, governors, and law enforcement people might be arrested.   Governors like Illinois Governor JB Pritzker who declares “The State of Illinois will Stand Up for the Rule of Law”.

Then we have that giant intellect, Chris Christie, who says while Judge Dugan over stepped her bounds, but she shouldn't be put in jail.  Over stepped her bounds? So that's what it's called with someone helps criminals to escape law enforcement?  Remarkable!
 
Then there's Judge Andrew Napolitano, who went over to the dark side years ago, says Trump overreached with this arrest, calling it a, ‘Jihad Against Judges’, decrying administrative warrants, and saying he thinks this judge has immunity.  Well, that's not a universal view, and apparently she also thinks she's not immune since Dugan has added a former Bush solicitor general to her high priced defense team.  Who's funding that?

Jonathan Turley seems to think it's "out-of-control judges, not FBI, appear to have crossed 'red line', and a black robe doesn't make one immune from the rule of law".   A Yale law professor thinks the arrest is legitimate.  The Wisconsin state Supreme Court, a very liberal court, has temporarily pulled this judge from the bench, with former Governor Scott Walker saying:  "It is time for the members of the Wisconsin State Legislature to vote to remove her from office."

The complaint is the Trump administration is doing this to send a message.  Good, and in point of fact, Congress Should Expand Scope of Expedited Removals to Include Mass Deportation.

As for calling this arrest a "jihad against the judiciary", here's who threw down the gauntlet.

One more thing.  It's long past time former Biden and Obama administration officials faced the consequences for the crimes they committed while in office, including Mayorkas! For murder.

 



Voter ID and The Constitution

On April 26, 2025  posted this article at Liberty Nation News, Voter ID: Where the President, the People and the Constitution Stand, saying "popular doesn’t necessarily equal constitutional".

He goes on to explain:

DC District Judge Colleen Kollar-Kotelly  ruled that states don’t have to make voters show ID at the polls or show proof of citizenship to register. Trump is a fan of voter ID requirements, and so are most Americans, according to polling. But if the Constitution doesn’t support that position, then neither public opinion nor the president’s order makes it legal.

First, the DC District is filled with leftist political hacks, and she's one of them.  He then goes on to point out the Constitution defines the rules governing the federal government's role in national elections quoting the first paragraph of Article I, Section 4 which reads:

“The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.”

He went on to explain:

Each state is explicitly granted the authority to determine when, where, and how US senators and representatives are elected. Then there’s an exception to that authority: Congress can legislate it at any time (well, all except the polling places). Note the lack of authorization for a president to override the states. The federal government can step in, but it has to be through the standard legislative process ......

He goes on to justify Judge Kollar-Kotelly's ruling noting there's nothing in the Constitution that allows the President to short circuit the legislative process, and she's right, but since when did that matter to the judiciary?  All of a sudden the leftist hacks in the federal judiciary are in love with the actual wording in the Constitution, incapable of seeing any penumbras or emanations of the Constitution to justify the President imposing voter ID on the states.  

Penumbras and emanations of the Constitution is a concept created by the judiciary, that also appears nowhere in the Constitution, but it allows them to bypass the legislative process in order find imaginary rights in order to impose laws on the nation no one passed, like the abortion, and the Chevron decisions.  It's kinda like how Hollywood twists inconvenient history in their movies with the attitude, "if it didn't happen that way, it should have".  

Yet, clearly it was the intent of the Founding Fathers that only citizens should be allowed to vote.  So, why wouldn't that justify taking the position the President was merely enforcing an unwritten law.  An unwritten law that was an obvious and understood unwritten law.  An unwritten law that didn't need to be written through the legislative process? 

Andrea posted this article in 2021, Clarence Thomas identifies the greatest danger in America, saying :

Article III of the Constitution of the United States establishes a “supreme Court.” .........While Art III limits somewhat the nature of the cases the Supreme Court may hear, it does not impose any checks or balances on the Supreme Court’s power.  Then, in 1803, Chief Justice John Marshall extended the Court’s power, holding that Article III’s grant of authority inevitably gave the Court the power to overturn unconstitutional legislation. The result is a Supreme Court that has freely rewritten the Constitution to achieve political ends—and turned the Court itself from what should be a neutral judicial institution into one that has become the partisan center of D.C.

The Constitution gave Justice Marshall no such authority. The Constitution says the jurisdiction of the federal judiciary is in the hands of the Congress, not the Supreme Court. 

The public is hugely in favor of Voter ID with 98% of Republican, 84% of independents and 67% of Democrats in support.  Five states already require it, another 40 are considering doing so, and currently there's legislation introduced by Rep. Chip Roy of Texas that's passed the House called "The Safeguard American Voter Eligibility (SAVE) Act", that's in the Senate.  But it must meet the 60-vote threshold to get voted on.  Why 60 votes?  

In 1975, the Senate reduced the number of votes required for cloture from two-thirds of senators voting to three-fifths of all senators duly chosen and sworn, or 60 of the current 100 senators. Today, filibusters remain a part of Senate practice, although only on legislation.

Will it pass the Senate?  Who knows?  If all 53 Republicans sign on, including Murkowski, Collins, Mitch McConnell, which is iffy, that would take seven Democrats to cross over.  Given the mental and moral unfitness of so many Republicans in the Senate, I don't think it can happen unless at least a minimum of ten Democrats cross over, and I really don't see that happening.

So, why is it the courts can't find even one little penumbra or tiny emanation to justify Trump's policy?  Because  the federal judiciary is rife with incompetent, not very bright, corrupt political hacks who can't be fired.  That's what needs changing.

They're wrong!

The Judiciary is Out of Control: SCOTUS

I have a massive number of drafts in my files, and I try to organize them topically by way of gazettes, and that included the judiciary, which is out of control.  On April 13th I published My Judiciary Gazette, organized by resistance to Trump, judicial corruption and lawfare, immigration, judicial overreach, DOGE, hiring and firing, control of funding, purging the deep state bureaucracies including the military, tariffs, and I keep adding updates and this is like a daytime nightmare that lingers and grows.  So, I've decided to separate all of this, starting with SCOTUS.

You will find there are only two real justices on the Supreme Court, Justices Clarence Thomas and Samuel Alito.  Three are outright leftist political hacks and four are seriously confused legal hacks, including Chief Justice Roberts.

Is it any wonder the public's trust in the Judiciary is plummeting? 
 
The American Judiciary is facing a crisis of confidence as public outrage swells over federal judges’ repeated interventions in President Donald Trump’s agenda.  In just the past few days, rulings blocking foreign aid freezes, personnel shakeups, and terrorist deportations have sparked a firestorm, with social media erupting in accusations of bias, corruption, and judicial overreach.  At the center of the storm: Chief Justice John Roberts, whose rare public statement today defending the courts has only deepened the divide.............

If Congress doesn't step and and put this to a stop, we're fast reaching the Jacksonian solution, they make their judgement, now let them enforce it.

The Judiciary is in Serious Need of Restraint

The Judiciary and America's Third Revolution: Part III

We already know the federal judiciary is filled with not very bright political hacks who think they are the real legislative and executive branches of government, not the Congress and most assuredly not the President of the United States.  All of which is promoted in the nation's law schools.   What's worse, their seditious and treasonous concepts are like a contagious disease, so when the federal judiciary can pervert, subvert, and ignore the Constitution, why shouldn't the state's courts?

On February 7, 2024 Hawaii's Supreme Court issued a decision saying that the U.S. Supreme Court’s Bruen (2022) does not surpass Hawaii’s constitution, which recognizes “no state constitutional right to carry a firearm in public.”  The decision came in Hawaii v. Wilson, a case in which Wilson is seeking recognition of his right to carry a gun in public for self-defense without first acquiring a permit from the state.... 

Their Supreme Court's ruling totally ignores Supreme Court decisions on the Second Amendment deciding they don't apply to Hawaii!  Why?   Because there's "no state constitutional right to carry a firearm"!  They've claimed “Conventional interpretive modalities", whatever the heck that means, shows there is no historical right to bear arms, and all this silly “founding era’s understanding of the Constitution" is meaningless.  

So, this insurrectionist court is in effect throwing the Constitution out the door, stating there's no reason for "contemporary society to pledge allegiance to the founding era’s culture, realities, laws, and understanding of the Constitution", because it is in conflict with the "Spirit of Aloha", whatever the heck that means!  It appears the court believes people have no right to bear arms in order to protect themselves from the "deadly aims of others".   Is it any wonder they believe the Spirit of Aloha is in conflict with the Bill of Rights. 

Secessionists?  Really?  C'mon man, that's irrational.  No, it's history, and it's reality.   On January 11, 2024, a month before this decision, Daniel Greenfield published this piece,
Communist Lawyers Sue to Create a Secessionist Monarchy in Hawaii, calling for an end to the U.S. occupation of Hawaii and the restoration of the Hawaiian Kingdom, which bears "a certain irony in a former Communist front group fighting to create a secessionist Hawaiian monarchy out of a republic. But as Stalin told his mother, “I am the new czar”'.
People are what they do, and what these rogue judges are doing is flat out radical insurrection, and they need to be called to account for the what I consider the criminal damage they're doing.   It's time Congress got nasty and started overturning these insane decisions, and create a law that can impose criminal sanctions of judges who are openly, or subtly, destroying the rule of law.   Again, the nation is in serious need of a 28th Amendment.

I save a lot of articles dealing with every issue facing humanity in order to use them as sources, and that includes a lot of articles dealing with the corruption of the judiciary.  The trouble with that is I end up with a lot of unorganized drafts making it hard to find the article I may need.   So, I decided it was time to organize them properly.
