What we're seeing in Los Angeles is a full blown insurrection.
Buildings have been burned. Vehicles set aflame. Federal officers assaulted. Immigration enforcement disrupted. And worst of all, those organizing and fueling the chaos are openly and proudly doing so under the false pretense that Los Angeles is a “sanctuary city,” immune from federal immigration law.
This isn't about free speech, and the President has every right to nationalize the California National Guard, and send in Marines, and can do so under the Insurrection Act of 1807, which the "law allows the president to deploy the National Guard or other U.S. military personnel to put down an uprising that interferes with the rights of the populace if “the constituted authorities of that state are unable, fail, or refuse” to do so."
It provides some of the only exceptions to the Posse Comitatus Act, an 1878 law that generally forbids the use of the military against American citizens. Those exceptions include suppressing insurrections, enforcing federal authority, and protecting civil rights when state authorities fail to act........George Washington called up state militias under the 1792 law to suppress the Whiskey Rebellion.........Abraham Lincoln at the outset of the Civil War, and afterward by President Ulysses S. Grant against the Ku Klux Klan........Dwight D. Eisenhower and John F. Kennedy invoked it during desegregation disputes in the South.
